Cape Vincent Town planning board to revisit 2005 Carlton Island Subdivision.

Tonight's Town of Cape Vincent Planning Board meeting was attended by fifteen people and there were no privilege of the floor comments from attending citizens.

Alternate Bob Cardarelli was sitting in for regular member Butch Cullen.

PB Chairman Richard Macsherry announced that there would be fee revisions for Planning Board Services and they will be announced at a later meeting.

After several comments from board members, the new town by-laws were approved. 

The new PB by-laws include a provision for a paid secretary who does not sit on the board.
Macsherry said that Town Attorney Mark Gebo and the Association of Towns both suggest that a sitting board member should not be also burdened with taking minutes. Cape resident Kathy Pierce has submitted an application for the position. It was pointed out that Kathy has been serving as recording secretary for the zoning ordinance working committee, is doing an excellent job and her present position familiarizes her with the zoning ordinance development.

The board approved hiring Kathy Pierce as recording secretary.

Macsherry reported that TDS would like to submit applications for two new micro-wave towers. One on the Valley Road, County RT. 6, and the other on Granadier Island.

approval of a subdivision near
Fort Haldimand on Carlton Island.
As a result of a letter from the New York State Historical Preservation Office, Chairman Macsherry announced that the Town Planning Board may have to revisit a Carlton Island subdivision that was approved by the town in 2005. There are concerns about how the town handled that division.

A question on the SEQR review asked if the subdivision involved any land that may have areas of historical significance. The former planning board chairman answered no. The town has been provided maps and other information that indicates that there may be as many as three burial grounds in the vicinity of the approved subdivision which is located on the west end of Carlton near the fort. There is also information that indicates that there may have been a Native American settlement near the fort as well.  At this time no land has been sold from the subdivision. The State's concern is that if someone starts building and they discover sensitive remains  it would be very costly for the purchaser of that land to resolve the situation. Chairman Macsherry's concern is that if the town was "faulty" in granting the approval for the subdivision, the town could incure costly consequences.
